How Lombard Financing collects, uses, and protects personal data submitted through the confidential enquiry form and other channels.
This Privacy Notice describes how Lombard Financing (“the firm”) collects, uses, and protects personal data submitted through this website. The firm is the data controller. It is to be read in conjunction with the Terms of Use and the Disclosures.
1. Controller and applicable law
The controller of personal data collected through this website is Lombard Financing, Rue du Rhône 14, 1204 Geneva, Switzerland. Personal data is processed in accordance with the Swiss Federal Act on Data Protection (the FADP, or nLPD). Where a visitor is located in the European Economic Area or the United Kingdom, the firm also processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the UK GDPR to the extent those regimes apply. 2. Data we collect
The firm collects personal data submitted by the visitor through the confidential enquiry form on the Contact page — typically: name, email address, role or capacity, entity name (optional), listing market, ticker(s), indicative position size, and a free-text description of the requirement. The firm also collects personal data submitted by direct email to enquiries@lombardfinancing.com or through other written channels.
The firm does not deploy advertising trackers, cross-site behavioural profiling, or session-recording tools. The website may use minimal first-party cookies strictly necessary for its operation (for example, preserving the mobile-navigation drawer state) and a first-party analytics measurement to understand aggregate usage. No decision producing legal or similarly significant effects is taken about a visitor on an automated basis.
3. How we use the data
Personal data submitted by the visitor is used solely to respond to the enquiry — to assess the contemplated transaction at a preliminary level, to issue indicative terms if appropriate, and to facilitate any engagement that follows. The data is not sold, leased, or otherwise made available to third parties for marketing purposes. It is shared with third parties only where necessary to provide the service requested (for example, with a custodian, a lending counterparty, or counsel engaged on the transaction), and only with the visitor’s knowledge.
4. Lawful basis
Under the FADP, the firm processes personal data on the basis of its legitimate interest in evaluating and responding to an enquiry made to it, and in a manner proportionate to that purpose. Where the EU or UK GDPR applies, the firm relies on Article 6(1)(b) (steps taken at the request of the data subject prior to entering into a contract) and Article 6(1)(f) (the firm’s legitimate interest in assessing the contemplated transaction). Where consent is required for any additional processing, the firm will obtain it.
5. International transfers
The firm is based in Switzerland, which the European Commission recognises as providing an adequate level of data protection. Where personal data is transferred to a country that does not benefit from an adequacy decision, the firm relies on appropriate safeguards, such as the applicable standard contractual clauses, and processes the data only to the extent necessary to respond to the enquiry.
6. Retention
The firm retains personal data submitted through the enquiry form for as long as is reasonably necessary to respond to the enquiry and to maintain records of any subsequent engagement. Records relating to enquiries that did not result in a transaction are retained for a reasonable period to permit follow-up; records relating to consummated transactions are retained in accordance with the firm’s record-keeping obligations under applicable law.
7. Your rights
Subject to applicable law, the visitor has the right to request access to the personal data the firm holds about them, to request correction of inaccurate data, to request erasure of data no longer required, to object to or request restriction of certain processing, and, where the GDPR applies, to data portability. A visitor also has the right to lodge a complaint — in Switzerland with the Federal Data Protection and Information Commissioner (FDPIC), and in the EEA or the United Kingdom with the competent supervisory authority. 8. Security
The firm maintains reasonable technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction. No system is impenetrable; the firm cannot guarantee absolute security and does not warrant the security of any data transmitted to it over the public internet.
9. Changes to this notice
The firm may amend this Privacy Notice from time to time. Amendments take effect when published on this page. The date of last modification is shown in the page metadata.
